Fernandez estate may face probate and estate administration issue

by | Feb 9, 2017 | Probate & Estate Administration |

When a loved one dies suddenly, especially at a young age, there may be a possibility that the individual did not create an estate plan. As a result, probate and estate administration concerns may arise due to the lack of a will and other documents. In many cases, surviving family may face complications when it comes to ensuring that the estate is properly handled.

Texas residents may be interested in the issues surrounding the estate of late professional baseball player Jose Fernandez. Fernandez died last year in a boating accident that also claimed the lives of two other individuals. Because he died without a will, his mother recently petitioned the court for control of the estate. Reports indicated that his estate’s worth estimates to about $2-$3 million.

Many issues could surround the administration of the estate as Fernandez’s girlfriend was pregnant at the time of his death. His daughter has since been born, and it is likely she will inherit at least a portion of her father’s estate. Additionally, lawsuits could be filed against the estate from the families of the other two victims of the boating accident as the boat belonged to Fernandez, and he was reportedly under the influence at the time of the incident.

Complications relating to probate and estate administration could weigh heavily on the surviving family. Therefore, if Texas residents are facing potential litigation regarding loved ones’ estates or other similar issues, they may wish to understand their legal options. Speaking with experienced attorneys could help individuals plan for and address potential complications.
